Terms of Service

Effective date: September 29, 2026

These terms govern your use of thehairist.com (the "Site") and every purchase you make from The Hairist, the trading name of FDSF FF LLC, located in Congress, AZ. By browsing the Site or placing an order you accept these terms together with our Privacy Policy, Shipping Policy and Refund and Returns Policy. If you do not agree with them, please do not use the Site.

1. Who may order

You must be at least 18 years old, or use the Site with the consent of a parent or legal guardian, and you must be able to form a binding contract. When you place an order you confirm that the information you give us is accurate, current and complete, and you agree to keep it that way.

2. Your account

You do not need an account to order, but if you create one you are responsible for keeping your login details private and for everything done through it. Tell us at support@thehairist.com straight away if you suspect someone else has used your account.

3. Products and pricing

We sell Bathroom Accessories products and related home goods, described as accurately as we can on each product page; colours can look slightly different on different screens. Prices are shown in US dollars (USD) and exclude sales tax unless stated; the full amount, including tax, is displayed before you confirm. We may change prices, product listings and availability at any time without notice. If a product is listed at an obviously incorrect price or with an error in its description, we may cancel the affected order and refund you in full, and we will tell you why.

4. Orders and acceptance

Your order is an offer to buy. We accept it when we send the shipping confirmation; the order confirmation email only records that we received it. We may refuse or cancel an order where we suspect fraud, where stock is unavailable or where a pricing error occurred. To cancel an order yourself, contact support@thehairist.com as soon as possible; once an order has been processed or handed to the carrier it may no longer be possible.

5. Payment

We accept Shop Pay, Shop Pay Installments (orders of $35 or more), Apple Pay, Google Pay, PayPal, Venmo, Visa, Mastercard, American Express, Discover, Diners Club, Elo, JCB, and UnionPay. Payment is taken at checkout through Shopify Payments over an encrypted connection, and there are no charges beyond the total displayed before you confirm. You confirm that you are authorised to use the payment method you provide.

6. Shipping

We ship to all 50 U.S. states and nowhere else. Standard shipping is free on every order with no minimum. Processing and transit times, the cut-off time and what to do about a delayed parcel are set out in our Shipping Policy, which forms part of these terms.

7. Returns and refunds

We accept returns for manufacturing defects, transit damage and wrong items received, within 30 days of delivery, on the conditions in our Refund and Returns Policy. That policy also forms part of these terms; please read it before you buy, because change-of-mind returns are not accepted.

8. Intellectual property

The text, photographs, graphics, logos and layout of the Site belong to The Hairist or to the licensors who allow us to use them, and are protected by copyright and trademark law. You may view and print pages for your own shopping; you may not copy, republish, scrape or exploit any part of the Site for commercial purposes without our written consent.

9. Acceptable use

You agree not to use the Site for anything unlawful or fraudulent, not to interfere with its security or availability, not to upload malicious code, not to attempt unauthorised access to any part of it or to any related system, and not to harvest or copy its content by automated means.

10. Disclaimer of warranties

The Site and the products are provided "as is" and "as available". We work to keep the Site accurate and running smoothly, but we do not warrant that it will be uninterrupted, error-free or free of harmful components, or that product descriptions are perfect in every detail. Any statutory warranties that cannot be excluded by law are unaffected.

11. Limitation of liability

To the fullest extent permitted by law, neither The Hairist nor FDSF FF LLC will be liable for indirect, incidental, special, consequential or punitive damages, including lost profits, revenue or data, arising from your use of the Site or from any product bought through it. Where liability cannot be excluded, our total liability for any claim is limited to the amount you paid for the order concerned.

12. Indemnification

You agree to indemnify and hold harmless FDSF FF LLC, its officers, employees and agents against any claim, loss or expense, including reasonable legal fees, arising from your breach of these terms or your misuse of the Site.

13. Privacy

The way we handle your personal information is described in our Privacy Policy, which applies to every use of the Site.

14. Governing law

These terms are governed by the laws of the State of Arizona and the federal laws of the United States, without regard to conflict-of-law rules. Any dispute arising from these terms or from your use of the Site will be heard in the courts of the State of Arizona, and you consent to their jurisdiction.

15. Changes to these terms

We may update these terms from time to time. The current version is always published on this page with its effective date, and using the Site after a change means you accept the revised terms. If any provision is found unenforceable, the rest remain in force.
